Due to the increase in tenants’ requests for emotional assistance animals, the HUD (U.S. Department of Housing and Urban Development) publishes new guidance on Fair Housing Act.
The guidance suggests that in order for housing providers to easily determine legitimate emotional assistance animal requests from illegitimate ones, the housing provider may have the right to inquire about the tenant’s condition and the assistant animal.
The housing provider may not accept self-diagnosis or based on internet certificates unless the tenant is receiving healthcare over the internet or has an observable disability.
