Question: Someone asks you why your animal isn’t wearing a vest or tag. What’s a good response?

Answer: “Under the ADA, there’s no requirement for any identifying gear or tags. There’s no registration or certification requirement. Each disabled owner can choose whether to have their Service Animal registered or wear gear or tags. For more privacy, I choose not to have mine wear anything that labels me as disabled.”

When can an airline require passengers to buy extra seats for their service animals?

iguana emotional support animal

Question: When can an airline require passengers to buy extra seats for their service animals?

Answer: An airline won’t require a passenger to purchase an extra seat unless the animal will not fit in the immediate seating area, lap, or under-seat storage area of the passenger. For example, a Great Dane might be denied cabin space unless an additional seat is purchased. However, if the flight happens has a lot of space available, the passenger may not purchase an additional seat.

What issues should you address in lawsuits concerning emotional support animals?

lawsuits emotional support animals

Question: What issues should you address in lawsuits concerning emotional support animals?

Answer: An owner using an exotic species or breed for an Emotional Support Animal would likely need to address these issues:

  • Whether the chosen species or breed presents a health hazard to others (i.e., a poisonous spider or full-blood wolf).
  • Whether there is a reasonable need to have that particular type of animal that a more traditional animal such as a dog, cat, or rabbit would not equally fulfill.

In summary, the question of exotics is not clear under existing law. A disabled owner/handler should consider whether or not a different breed would give equal assistance, because that question may come up if there is a future dispute.

Does the ADA give you legal right to take an in-training service animal in public?

assistance animal in public

Question: Does the ADA give you legal right to take an in-training service animal in public?

Answer: The Americans with Disabilities Act (ADA) does not apply to a service animal while that animal is still in training.

For example, if you would like to take a service-animal-in-training out to public spaces, the ADA does not give you that legal right and it is up to local state, county or city laws or the individual business owner, employer, or landlord to grant you access rights for that animal that is still in training.
