Answer: The airline may not require that the passenger purchase an extra seat unless the animal will not fit in the immediate seating area, lap, or under-seat storage area of the passenger. For example, a Great Dane might be denied cabin space unless an additional seat is purchased. However, if the flight happens to be fairly empty and there is a lot of space available, the passenger may not purchase an additional seat.

Question: Can a housing provider refuse an assistance animal for financial reasons?

Answer: Yes. The housing provider can refuseefuse to accommodate the request for an assistance animal if it would cause an undue financial burden on the landlord or hotel operator. For example, if the landlord’s insurance carrier would cancel the insurance policy if a certain breed of dog, such as a pit bull or chow breed, were kept on the premises, or if the accommodation would require extensive costs that would be considered objectively unreasonably high, such as physical alterations or construction.
